一、简介 Introduction：

商标(也称书面商标或商标)是一种知识产权，由可识别的标志、设计或表达组成，用以识别特定来源的产品或服务与其他来源的产品或服务。

A trademark (also written trademark or trademark) is a type of intellectual property consisting of a recognizable sign, design, or expression which identifies products or services of a particular source from those of others.

二、商标注册的要求 Requirements：

1:商标所有人的姓名和地址 Provide your name and address as owner of the trademark；

2:说明实体类型(个人或公司)和申请人的的国籍 

State the entity type (individual or corporation) and your national citizenship；

3:展示商标在商业上的实际使用或真正意图 

Demonstrate actual use or a real intent to use the trademark in commerce；

4:详细描述该商标 Give a detailed description of the product being trademarked；

5:交商标图样或样本 Submit a drawing or specimen of the trademark；

6:供商标首次使用的日期 Offer the date of the first use of the trademark；

7:授权委托书 Power of attorney；

三、注册流程 Registration Procedure：

第一步:商标搜索

对知识产权网站上各种类似标记的组合进行搜索。如果发现类似的标记，请检查说明，以确

定该标记是否代表您ᨀ出的同一套商品或服务。

The first step is trademark search. The search should be done in both for various combination of similar marks on the intellectual property website. In case similar marks are found, check the description to see if the mark represents the same set of goods or services proposed by you.

第二步:申请准备

商标代理人准备一份申请书。商标申请人须准备表格 48 及 TM-1 以供审批及签署

In the second step, an application is prepared by the Trade Mark Attorney. Form 48 and TM-1 will be

prepare for approval and signature of the trademark applicant.

第三步：商标注册。个人、创业、小型企业注册商标。向当地政府机关缴纳一定的费用。

第四步:政府处理 一旦交了商标申请，并且政府正在处理该申请，则必须定期检查商标申请的状态。如有异 议，申请人必须在 30 天内ᨀ交异议回复。同样，如有反对意见，申请人必须在限期内作出 回应，以免官方ᨀ出异议

Once a trademark application is filed and the Government is processing the application, the status of the trademark application must be checked periodically.

In case of objection, an objection reply must be submitted by the applicant within 30 days.

Similarly, in case of opposition, the applicant must respond in a time-bound manner to allay the

concerns of the counter-party.

备注：商标注册期间，如商标办公室ᨀ出异议，需要及时回复异议，并ᨀ交相应要求的补充

文件。也会根据申请商标的实际情况，当局要求进行当面申诉。

Note: during the period of trademark registration, if the trademark office raises an objection, it shall reply to the objection 3 in time and submit the supplementary documents as required. The authorities will also request a face - to - face appeal based on the actual circumstances of the trademark application.

四、周期 Timeframe： 

商标注册是一个漫长的过程，在没有任何异议或反对的情况下，在一个直接的案例中获得注

册需要大约 18-24 个月。如当局出任何异议时间顺延。

Trademark Registration is a lengthy process and it takes around 18-24 months to obtain registration in a straight-forward case, without any objections or oppositions. However, the trademark application number is usually issued within one or 2 days after filing. Delay in case of any objection.
